Chapter 12

Leigh touched the screen on her cell phone to dial her office and waited for Maureen to answer while she reread the email flagged high priority.

“Maureen, what is this? RMST versus Diane Nelson? When did this happen?”

“We just got the paperwork yesterday.” Maureen sounded as upset as Leigh. “Rocky Mountain Securities Technologies has filed against Diane and her parent company, Nelson Thomas Industries. They are asking for two hundred sixteen thousand for goods and services plus legal fees. I’m sorry to bother you with this while you’re out of town but Bev insisted I let you know.”

“Is Bev there?” Leigh squinted at the screen, rereading a paragraph.

“Let me see if she’s still in her office.”

“Leigh?” Bev sounded exasperated. She didn’t extend the normal telephone pleasantries but Leigh didn’t mind. She didn’t call to have a chit-chat with her ex. “RMST is suing Diane and she hasn’t even moved to her new offices yet. We’re looking at a couple hundred grand here. You need to get back here and have a talk with this asshole at RMST. I don’t have time and Diane trusts you.”

“Slow down, Bev.” Quiet practicality was never Bev’s long suit. “First, the lawsuit has something to do with the security system installed last month, right?”

“Damn right it does. Those idiots can’t read their own work orders. They installed their crap all over the building, even the basement parking garage, BY MISTAKE. They even admit it was a mistake. They were supposed to be across the street in the Kline Building. I’ve gone around and around with these people. I spent two hours on the phone with the supervisor. They’re going forward with this thing. I told the guy they can’t win and they’re going to end up paying Diane’s legal fees as well. We’ll countersue.”

“No, we won’t, Bev,” Leigh said, leaning back in her chair.

“What do you mean we won’t sue? What’s wrong with you, Leigh? Has that thin mountain air made you loopy? They installed that stuff in the wrong building. They admit it. They’ll have to eat it.”

“Bev, I read the email. Diane’s brother-in-law let them in the building. They told him what they were there to do. He knew Diane hadn’t signed a contract for security yet. She wasn’t sure which company she wanted to use. It was in the memo. RMST was on the premises for four days and no one said a word to them. No one asked for verification. Doug was even overheard telling Diane not to worry about a security system. Because the brother-in-law failed to stop the installation, with the intention of benefiting from the mistake, the court will create a quasi-contract. Knowing that it was a mistake and failing to stop the installation will be interpreted as an implicit agreement to pay. The court will treat it as if there was an actual contract. Bev, this is law 101. If a painter paints a house by mistake while the owner watches, he can sue for payment.”

“Leigh, this is Diane Nelson we’re talking about.
